Privacy Policy for fiba3x3.com, fiba3x3.basketball and play.fiba3x3.com

The Fédération Internationale de Basketball, Route Suisse, 5, PO Box 29, 1295 Mies, Switzerland (“FIBA”) is aware that you care about how your personal information is used and shared, and appreciates your trust that FIBA will do so carefully and sensibly. This Privacy Policy explains how FIBA and its affiliates (hereinafter “we”) process Personal Data in connection with fiba3x3.com, fiba3x3.basketball and play.fiba3x3.com (collectively hereinafter the "Platform"). This Privacy Policy forms part of the Platform's Terms and Conditions (a link to which can be found in the footer of every webpage of the Platform).

Throughout this Privacy Policy, the term “Personal Data” means information relating to an identified or identifiable individual (i.e. a natural person), e.g. name, address, telephone number etc.

This Policy applies to the collecting or processing of your Personal Data, but only insofar as we control the data. In particular, the Platform contains links to third party websites. Please note that we are not responsible for the privacy policy of these third parties.

Anonymous Information

You may register to the Platform (which makes you a “Registered User”) or may not register; if you decide not to register with the Platform, we will not collect or process any Personal Data from you except when an organiser of an event creates a non-registered user account on your behalf. Apart from such non-registered user accounts, we may only collect and process certain anonymous information from non-registered users (which may also be collected from Registered Users), in particular:

a) Name of your internet service provider;
b) Last 8 Bits of your IP address assigned to you when you visit the Platform;
c) Website which you visited immediately beforehand;
d) Date, time and duration of your visit;
e) Websites you accessed on the Platform;
f) Links you used;
g) Ad-banners and other content you viewed; and
h) Technical information about your devices and other technical information your browser provides us with.

Any such anonymous information is used by us only for statistical purposes, which allows us to improve the Platform.

Google Analytics

We use a tool called “Google Analytics” to collect information about the use of the Platform. Google Analytics collects information such as how often users visit the Platform, what pages they visit when they do so, and what other sites they used prior to coming to the Platform. We use the information we receive from Google Analytics only to improve the Platform. Google Analytics collects only the last 8 Bits of the IP address assigned to you when you visit the Platform, rather than Personal Data. We do not combine the information collected through the use of Google Analytics with Personal Data. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this site by disabling cookies on your browser.

Non-registered user accounts

If an organiser of an event and/or a team lead creates a non-registered user account on your behalf, the below provisions on the use of Registered User’s Personal Data shall apply. However, unless and until you turn the non-registered user account into or merge it with a Registered User profile, we will publicly display (in particular in rankings and statistics) only your first name and the first character of your last name as well as your country and city of residence, nationality, gender and birthdate.

Use of Registered User's Personal Data

By registering with the Platform, be it via the fiba3x3.com website or the mobile application (“3x3App”), you agree to the collection and processing of your data as explained in the following. If you do not agree with the following, please do not register with the Platform.

1. What data do we collect?

1.1. “Registration Data”, i.e. the data which you are required to provide when registering for the Platform (in case of non-registered user accounts, the organizer may choose to enter only some of the data mentioned below):

a) your e-mail address, which may also be used as your user name;
b) your phone number, which may also be used as your user name;
c) custom URL (web address) for your fiba3x3.com profile, auto-generated from first name and last name unless edited by the user;
d) Password or federation of 3rd party social media identity such as Facebook, Google, QQ or Weibo; e) First and last name;
f) Date of birth;
g) Nationality / nationalities;
h) Gender; and
i) Country and city of residence.

1.2. “Optional Data”, i.e. the data which you voluntarily provide on the Platform, or to organizers who provide the data to the Platform, for example:

a) Full address;
b) Secondary e-mail addresses;
c) Physical address;
d) Player profile picture and personal cover photo;
e) Content you upload to the Platform;
f) Nickname;
g) Description of yourself ("short bio");
h) Height;
i) Weight;
j) Your social graph of people you follow on the Platform and the identities of your teammates in the 3x3 competitions; and
k) Your social media profiles and links.

1.3. “Competition Data”: Results of 3x3 Competitions which are notified on the Platform (either by you or any third party, e.g. organizers of 3x3 Competitions in which you participated), i.e. scores and individual and general statistics of 3x3 Competitions in which you participated. The term “3x3 Competitions” includes (also hereinafter) any and all FIBA-endorsed competitions and pick-ups to the extent relevant for Rankings on the Platform (for more information on Rankings see http://www.fiba3x3.com).

1.4. "Audio-visual Material": Photographs, audio and/or video material of you taken during 3x3 Competitions in accordance with clause 9.1.a) of the Platform's Terms and Conditions.

1.5. “Anti-Doping Data”: Personal data from you which relates to doping control tests, results management and disciplinary proceedings and which is collected in accordance with the applicable anti-doping regulations, either by ourselves or by your National Federation or any (other) national or international Anti-Doping-Organization, who then forward this data to us.

1.6. “FIBA3x3 ID”: A unique alphanumeric string assigned to your Platform profile.

1.7. “Cookie Information”: Cookies are small text files which are sent to your computer by a web server and saved on your hard drive so that the web server can “remember” who you are; the use of cookies can be deactivated in your browser settings, which may however affect the proper functioning of the Platform in your browser. There are two types of cookies that may be used on the Platform:

a) “Session Cookies” are valid only for the active browser session; and
b) “Permanent Cookies” are used to save information over multiple sessions.

2. How do we address the privacy of children?

2.1. FIBA is concerned about the safety and privacy of all its users, particularly children. If you are less than 13 years old, you will therefore receive a specific user profile which allows you to remain anonymous, meaning that no Personal Data from you will be collected. Instead of the Registration Data required when registering for a standard profile (see clause 1.1. above), the only information we will request (and allow) you to provide us with in this case is the following:

a) Unique nickname, which must not include your real name or disclose any other Personal Data such as phone number or address;
b) Password;
c) Birthdate;
d) Gender;
e) Country and city of residence; and
f) Nationality.

2.2. We will not allow any Optional Data or Audio-visual Material on the Platform with respect to persons younger than 13 years. If such data comes to our attention, we will remove it. Also, we will not allow use of social plugins by Registered Users who are less than 13 years old. Even though Competition Data may be used also for Registered Users below 13 years, it will remain anonymous due to the specific user profile described in clause 2.1. above. If you participate in 3x3 Competitions, you will do so under your nickname, meaning that you will not reveal your real name at 3x3 Competitions.

2.3. Once you are 13 years old, if you wish to continue using the Platform, you will be prompted to provide the additional information necessary for a standard profile (see Registration Data in clause 1.1. above).

3.1. How will your Personal Data be used?

a) We apply very high data protection standards. In particular, we will not disclose any Personal Data to third parties unless authorized to do so by law or by virtue of your consent to this Privacy Policy (which does not in any way restrict our rights as provided by the applicable laws).

b) If you have registered yourself on play.fiba3x3.com and you are part of an organizer account on the Platform’s related em.fiba3x3.com, please be aware that FIBA may share the relevant contact details provided for an organizer with:

i) the national federation corresponding to the territory said organizer had or has any kind of activity (including digital one) for sporting and development purposes

ii) providers of FIBA-approved equipment to ensure safety standards at your events.

The information we may share:

3.2. How will Registration Data be used?

a) We may use your Registration Data to the extent necessary for the proper administration of your account.
b) We may use all of your Registration Data with the exception of your password

i) To personalize our services to you and to send you related notifications or messages, e.g. to inform you about 3x3 Competitions in your area or about other content relevant to you;
ii) To include it in other FIBA databases on basketball players;
iii) Solely for sporting purposes, to be made available to the national basketball federation(s) for which you are eligible to play, or to third parties on behalf of such national basketball federation(s); and
iv) To be made available to the organizers of 3x3 Competitions to which you have registered in the past, solely for the purpose that such organizers may contact you via other means than the Platform and invite you to participate.

c) We may use your first and last name, date of birth, nationality, gender, country and city of residence
i) To create and publish Rankings and/or any other statistics;
ii) To be shared via FIBA APIs with FIBA’s application and service partners such as sports analytics companies, betting companies, health and fitness service providers, sports news companies and academics;
iii) For validation purposes when you register to 3x3 Competitions;
iv) For display in your Platform profile which can be seen by all Platform users; and
v) For a player search tool, which enables users of the Platform to find players meeting certain criteria.

3.3. How will Optional Data be used?

a) Your Optional Data will be visible in your profile to all other Platform users.
b) We may use your Optional Data to personalize our services to you and to send you related notifications or messages, e.g. to inform you about 3x3 Competitions in your area or about other content relevant to you.
c) If you have registered for a 3x3 Competition, your Optional Data may be used by the organizer of this competition for the promotion thereof, and by us for communication, marketing and media purposes in accordance with clause 9.1. of the Platform's Terms and Conditions.
d) We may share your player profile picture via FIBA APIs with FIBA’s application and service partners such as sports analytics companies, betting companies, health and fitness service providers, sports news companies and academics.

3.4. How will Competition Data be used?

a) We may use your Competition Data (in connection with the Registration Data as per clause 3.2.c) above) to create the Ranking and/or other statistics.
b) Your Competition Data and/or the Ranking and other statistics based thereon (together with Registration Data as per clause 3.2.c) above) may

i) be made available to all Platform users as well as to the general public by reasonable means, e.g. via newsletters and press releases;
ii) be used in connection with a player search tool in order to enable other users to find players of a certain skill level; and
iii) be shared via FIBA APIs with FIBA’s application and service partners such as sports analytics companies, betting companies, health and fitness service providers, sports news companies and academics.

3.5. How will Audio-visual Material be used?

Audio-visual Material may be used by us for filling in your profile page and for communication, marketing and media purposes in accordance with clause 9.1. of the Platform's Terms and Conditions.

3.6. How will Anti-Doping Data be used?

Anti-Doping Data may be used solely in accordance with FIBA’s players’ information notice on doping control-related data (“PIN”), which is herewith incorporated by reference and which is available for download at http://www.fiba.com. Your acceptance of this Privacy Policy shall serve as “Player’s Declaration” within the meaning of the PIN.

3.7. How will the FIBA3x3 ID be used?

All your Personal Data in the Platform's database will be associated with your FIBA3x3 ID. Whenever any of your Personal Data is processed, the relevant database query will use your FIBA3x3 ID to identify your data in the Platform database. Therefore, any processing of your data may involve processing of the FIBA3x3 ID associated with your account.

a) We may use cookies for displaying advertisements on the Platform, especially to avoid showing the same advertisement all the time.
b) Session Cookies will be used to persist the user’s session across page views.
c) Permanent Cookies will be used to keep you logged in across browser sessions.

4. What will happen with your data when you unregister from the Platform?

Upon valid termination of your registration, your account will be anonymized. This means that your user name is changed to include just your first name and the first character of your last name. The information on country and city of residence, nationality, gender and birthdate is kept in order not to distort any statistics, but your full name and contact details, as well as any other registration and optional data will be deleted from our database.

5. Social Plugins

The Platform uses social plugins such as (without limitation) those provided by

• facebook.com, operated by Facebook Inc., 1601 S. California Avenue, Palo Alto, CA 94304, USA (“Facebook”); the plugins are identifiable by a Facebook logo (white letter f on blue background or a thumb up icon) or the notice “Facebook Social Plugin”; for a full list of all social Plugins please see http://developers.facebook.com/plugins;
• plus.google.com, operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States; the plugins are labelled with the Google logo, the Google +1 logo or with the addition “Google Social Plugin”;
• twitter.com, operated by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA; the plugins are labelled with the silhouette of a bird, and usually show the words "twitter" or "follow"; and • instagram.com, operated by Instagram Inc., 1601 Willow Road, Menlo Park, California 94025, USA; the plugins are labelled with a stylized camera.

When you visit a Platform page that contains a social plugin, you browser establishes a direct connection to the servers of the provider of the respective social plugin in order to retrieve the contents of the social plugin. Due to this process, the provider of the social plugin will receive information about you having accessed the respective Platform page.

If you are logged into your account with the respective social plugin provider, said provider can match your visit on the Platform with your account. Furthermore, any interaction with the social plugin (e.g. clicking on “Like” or “+1” buttons) can result in Personal Data being transmitted to the social plugin provider. Please note that due to the direct connection between the social plugin and the server of its provider, we do not have any influence on the data gathered by the plugin and on how the provider processes that data. In order to inform yourself on the purpose and scope of data collection and procession by a social plugin provider, please consult the respective privacy policy of that provider, (see, e.g., http://www.facebook.com/about/privacy/, http://www.google.de/intl/en/privacy/, https://instagram.com/about/legal/privacy/ and http://twitter.com/privacy).

If you are logged in with social plugin providers, we may retrieve sign-up information from the respective provider such as your first name, last name, gender, date of birth, avatar, city and email. If you have given your express consent, we may also post messages on your “wall” (or comparable feature) with the social plugin provider.

6. Your interaction with other users

You will be able to "flag" other users who send irrelevant invitations to you or post offensive content related to you either via specific Platform “Flag as Inappropriate” functionalities or by contacting the 3x3 user support (link in the footer of the Platform). FIBA may then decide in its discretion to sanction those senders.

7. International data transfer and relocation of Servers

7.1. Users of the Platform may be located in countries outside of the European Union or European Economic Area. Consequently, you acknowledge that Personal Data which is accessible to other users may be transferred to users in countries where the data protection level is lower than within the European Union or European Economic Area.

7.2. The Platform’s main database may be spread over multiple servers throughout the globe, including outside the European Union or European Economic Area. You expressly agree that any data collected in accordance with this Privacy Policy may be stored and processed on any of those servers. The location of the servers will in no way affect the validity of this Privacy Policy, to which we remain committed even if the laws of the country in which the servers are located do not require such strict data protection.

8. Newsletter and notifications

8.1. If there is a Platform e-mail newsletter, you will not receive it unless you provide us with your express approval either when registering with the Platform (by ticking the respective checkbox) or at a later point in time. You can withdraw your approval at any time.

8.2. You recognize that some messages in the Platform's inboxes, notification centres and/or activity streams may be pushed to your screen as mobile push notifications. If you do not wish these messages to surface to the screen, you are responsible for setting the mobile phone settings to prevent such messages from being shown.

9. Revocation, right to information

9.1. You have the right to withdraw your consent to the processing of your data at any time. Notification of the withdrawal shall be made by email to the 3x3 user support (link in the footer of the Platform). Please understand that in this case, your use of the Platform may be blocked because the sharing of certain data is indispensable for the sensible operation of the Platform. Upon receipt of your withdrawal, we will block your data and prevent further processing, subject only to the limited processing of certain data as per clause 4. above.

9.2. Moreover, under certain circumstances, you are entitled to have your Personal Data corrected, deleted or blocked from use. If you make use of such right, the consequences explained in clause 9.1. above shall apply mutatis mutandis.

9.3. You are entitled at any time to obtain information about what Personal Data we have stored concerning you, and about the purpose for which it was stored.

11. Amendments

We reserve the right to amend this Privacy Policy at any time without providing reasons unless this is unreasonable. If you are a registered user, you will be requested to accept these amendments upon logging in to your account the next time. If you do not accept the changes, FIBA may terminate your account, in which case clause 4. above applies.
